Information about the processing of personal data

Depending on your relationship with Klimat Plus, the owner of the Neka brand, we will process different categories of your personal data for different purposes.  Please see below for details of the purposes and ways in which we process your personal data.
 
‍Transmission of commercial and marketing information.

 
1. Customers and their representatives

 

Categories of personal data: Name, address, telephone number, e-mail, position and place of work, TIN, REGON, PESEL, identity document number and series.

 

Processing purposes:
To carry out normal customer relations, i.e.: administration of payments, general communication, management of daily operations in accordance with legitimate and fair business practices (including planning, execution and management of cooperation; statistics, analysis). Legal basis for processing this data: In the case of representatives, the data will be processed on the basis of a legitimate interest related to the performance of business relationships and contracts (Art. 6(1)(f) RODO).
Performance of a contract with an individual (Article 6(1)(b) RODO).
Provision of general customer service and support, including post-sale surveys. Legal basis: Legitimate interests of ensuring customer satisfaction and improving our products and services (Article 6(1)(f) RODO).
Obtaining customer information and knowledge about the use of our products and services (e.g. by sending satisfaction surveys or questionnaires). Legal basis: Consent of the data subject (Article 6(1)(a) RODO).
Preventing fraud and securing payment and establishing, protecting or pursuing legal claims. Legal basis: Legitimate interests to protect the interests of the company (Article 6(1)(f) RODO).

Storage period: Until the indicated purpose has been fulfilled, but no longer than 12 years from the last purchase of our products or services.

 

2. Potential customers and their representatives

 

Categories of personal data: Name, address, telephone number, e-mail, position/occupation and place of work.

 

Processing purposes:
Generation of business leads - see ‘Our advertising and marketing activities’ for more information. Legal basis: Consent of the data subject (in the case of electronic activities) or legitimate interests in promoting the company and selling our products and services (Article 6(1)(a), (f) RODO).

 

Measurement of effectiveness in customer acquisition - see ‘Our marketing and advertising activities’ for more information. Legal basis: Data subject's consent (for electronic activities) or legitimate interests in measuring the effectiveness of our activities (Article 6(1)(a), (f) RODO).
Acquisition of potential customers. Legal basis: Taking pre-contractual action (Article 6(1)(b) RODO).

 

Storage period:  Until the customer is acquired, but no longer than 5 years after the last interaction.
 
3. Suppliers of goods or services and their representatives

 

Categories of personal data: Name, business telephone number, e-mail, position and place of work, TIN, REGON, PESEL, identity document number and series, vehicle registration number, nationality.

 

Processing purposes: 
To carry out normal supplier relations, i.e.: administration of payments, general communication, management of day-to-day operations in accordance with legitimate and fair business practices (including planning, implementation and management of the cooperation, carrying out credit ratings, as well as conducting statistics and analysis). Legal basis: performance of the contract (Article 6(1)(b) RODO) - in the case of suppliers who are natural persons. Legitimate interest in order to conclude and perform the contract concluded with the supplier, to establish, defend or assert claims (Article 6(1)(f) RODO).
Sourcing and locating suppliers. Concluding and fulfilling the provisions of concluded contracts. Legal basis: Legitimate interest of satisfying business needs and conducting regular business activities (Article 6(1)(f) RODO).

 

Storage period: Until the indicated purpose has been fulfilled, but no longer than 12 years from the last purchase of products or services.

 

4. Recipients of marketing messages

 

Categories of personal data: Name, courtesy phrase, position/occupation place of work, e-mail, telephone number.

 

Purposes of processing: Distribution of marketing communications. Legal basis: Consent to receive marketing communications (Article 6(1)(a) RODO).

 

Storage period: Until you withdraw your consent to be contacted for marketing purposes.

 

5. Those using contact forms

 

Categories of personal data: Name, e-mail, telephone number, profession, company, town, country.

 

Purposes of processing: To provide a response. To provide the necessary information at the request of the person contacted, including the presentation of an offer. To communicate for marketing purposes, to promote and sell the company's products and services, and to provide support. Legal basis: If the enquiry concerns the (potential) conclusion of a contract, the legal basis will be to take the steps necessary to conclude a contract or to perform an existing contract (Article 6(1)(b) of the DPA). Consent to provide marketing information (Article 6(1)(a) RODO). If the enquiry does not concern a contract or an offer, the legal basis will be our legitimate interest in handling the enquiry (Article 6(1)(f) RODO).
 
Storage period: Until the end of contact and thereafter for the period necessary for our documentation purposes.
 In the case of data processed on the basis of consent, until the purpose ceases or consent is withdrawn.
 

6. Visitors to physical locations

 

Categories of personal data: Name, company name, registration number, if applicable, date and time of visit, identity document number.
 
 Video surveillance recordings, including image, date and place of recording, vehicle registration number and model.
 

Processing objectives: To ensure the security of our physical locations, to protect confidential information and to prevent and solve crimes at our physical locations. Legal basis: Legitimate interest to ensure security on the premises and to protect employees, visitors, information and property (Article 6(1)(f) of the DPA).

 

Storage period: Up to 2 years from the date of registration; Up to 90 days from the date of registration or as long as necessary in connection with an ongoing case.

 

7. Account users

 

Categories of personal data: Name, e-mail address, telephone, profession, company, address.

 

Processing purposes:

• To provide the user with our services on websites or applications. Legal basis: Performance of the contract for the provision of electronic services (Article 6(1)(b) RODO). Storage period: Until your account is closed and thereafter for the period necessary for our documentation purposes.

•  Transmission of commercial and marketing information. Legal basis: Consent of the data subject (Article 6(1)(a) RODO). Storage period: Until consent is withdrawn.

•  Management of user accounts created; for security, statistical and analytical purposes. Legal basis: Legitimate interest in conducting statistics and analysis to improve the user experience (Article 6(1)(f) RODO). Storage period: Until your account is closed and then for the period necessary for our documentation purposes.

8. Visitors to social media profiles

 

Categories of personal data: Information publicly available on a user's profile, including name, gender, marital status, place of work, interests, image and city; whether the user has ‘liked’ or used other reactions on our profile; comments left on our posts; content shared with the company with the intention of interacting;  the fact of visiting our profile; IP address.
 
Processing purposes: To improve our products and services, including our social media profiles and pages;
For statistical and analytical purposes; to communicate with users if they engage with our content (comments, reviews, messages); to re-share content shared with us.

Legal basis: Legitimate interest of being able to communicate with users and target marketing communications to users on our social media profiles, as well as our legitimate interest of improving our products and services (Article 6(1)(f) RODO).
